Terms & Conditions of the Project
This Service includes:
Pre-migration wireframe strategy session (2 hours)
Migration of up to 10 website pages, 3 funnels, and 1 course portal from Kajabi to HighLevel (or Nerdly, a white-labeled version of HighLevel)
Phone number registration and SMS setup
Funnel and automation audit (basic optimization)
30 days of post-migration support
Quick-start Loom trainings for using your migrated setup
Additional services — including extra pages, funnels, courses, screengrab archiving, or redesign work — are not included in this package and will incur separate fees, quoted and agreed upon in writing.
Only one migration project is taken per month to ensure high-touch service.
Booking the wireframe session secures Client’s place in the project queue; the official project start date is confirmed after the wireframe session.
Estimated completion is approximately 30 days from the assigned start date, assuming Client provides required materials and feedback promptly.
Delays caused by Client (e.g., late approvals, missing information) may extend the project but do not change payment due dates or eligibility for refunds.
Client agrees to:
Provide accurate and timely access credentials for Kajabi and HighLevel (or Nerdly).
Supply all content, assets, and information needed to complete the migration.
Attend the scheduled wireframe session and provide feedback within 2 business days when requested.
Acknowledge that failure to provide requested materials or feedback may result in delayed completion without altering payment obligations.
This Service is focused on migration and basic optimization of existing assets.
Redesigns, new content creation, or additional strategy beyond the agreed scope will be quoted separately.
Revisions are limited to corrections or adjustments related to the migrated content — not fundamental strategy or creative direction changes outside the wireframe.
All payments for this Service are final and non-refundable. Due to the custom and digital nature of the work, no cash refunds will be issued under any circumstances, including but not limited to changes in business direction, financial hardship, or client delays.
Payment Plan Exception:
If the Client is on a two- or three-payment plan and wishes to cancel before the second or third payment is due, they may do so by providing at least 7 business days’ written notice prior to the payment due date.
In this case, no refund will be provided for payments already made; however, a partial credit toward other services may be applied at the sole discretion of the Service Provider.
Provider-Initiated Cancellation:
If the Service Provider must cancel the project for reasons solely attributable to them (excluding Force Majeure or Client-caused delays), a prorated credit may be offered toward future services, not a cash refund.
Service Provider is not liable for:
Loss of data resulting from Client’s failure to maintain backups
Pre-existing issues within Kajabi, HighLevel, or Nerdly platforms
Delays caused by Client’s failure to provide required information or timely approvals
Indirect, incidental, or consequential damages arising from or related to this Service
Fonts, images, or other media provided by the Client that do not have appropriate commercial usage rights
Client is responsible for ensuring any fonts, images, or other assets they supply are:
Licensed for commercial use, or
Purchased by the Client with appropriate permissions for inclusion in their project
If unlicensed fonts or images are requested by the Client, the Client assumes full legal and financial responsibility for any claims arising from their use.
Service Provider shall not be held liable for delays or non-performance due to events beyond reasonable control, including but not limited to natural disasters, acts of God, government actions, pandemics, labor disputes, equipment failures, internet outages, or other Force Majeure Events. In such cases, timelines may be adjusted without penalty, and no refunds shall be issued.
This Agreement is governed by the laws of the Country of Canada. Any disputes shall be resolved in the courts of Canada, without regard to conflict of law principles.
This Agreement supplements and works alongside the general company Terms & Conditions. Together, they represent the full understanding between Client and Service Provider regarding this specific Service.
By booking the wireframe session and/or making payment, Client acknowledges they have read, understood, and agreed to these Terms & Conditions.
